    中川 寛子
    令和5年度には、欧州一般裁判所によって下されたGoogle Android事件判決(Judgment of 14.9.2022, Case T-604/18)をめぐる議論の検討を中心に、研究を進めた。同事件では、Googleがアプリストア、検索アプリ、検索ブラウザを抱き合わせたことが問題視された。そこで、同事件においてどの市場におけるどのような力をどのようにレバレッジしていたのか、レバレッジがどのように機能していたかの検討を行った。Googleはいずれの市場においても市場支配的地位を有していたことから、従たる市場における競争制限を起こすタイプのレバレッジではなく、市場支配的地位にある全ての市場での地位・力を相互にレバレッジし、全体における参入障壁を引き上げる戦略が採用されたこと、さらに、各種契約条項を用いてモバイル機器メーカーに対し自己の検索アプリをデフォルトに設定させ、Googleにデータを集積させる施策を複合的に行っていたことがわかった。
    判決及び議論の大半は、抱き合わせのメカニズムだけではなく、デフォルト設定をいかに成功させたかに集中している。そのため、従来型の抱き合わせによる排除のメカニズムに加えて、検索アプリをデフォルトに設定することがいかに強い排除効果を発生させるか、という、デジタルプラットフォームならではの排除のあり方を理解するに至った。
    その他、DeNAによる囲い込み事件（公取委排除措置命令平成23年6月9日）、Booking.comによる同等性条件（公取委確約認定令和4年3月16日）についての評釈
    を執筆した。これらは、『経済法判例・審決百選（第3版）』に掲載が確定している。また、マイナミ空港サービスによる排他的取引事件（東京高判令和5年1月25日）の評釈を執筆し『令和5年度重要判例解説』への掲載が確定している。

  • The reach of predation theory in the regulation of exclusionary pricing conduct

    This study has focused on clarifying the reach of the theory and the legal standards which has been advocated for analyzing predatory exclusion. The main subject of the study are exclusionary conducts with price setting, particularly, Price Squeeze, Loyalty Rebate and Per-processor License (Reducing Rival’s Revenue). As widely known, these conducts have multiple aspects including Raising Rival’s Cost. So applying only the predation theory to these types of conduct does not always lead a proper legal reasoning nor conclusion. Therefore, we reached the view that utilizing several economic theory consistently is very important in analyzing whether those conducts fulfill legal requirements like: whether some aspects of a conduct is undue method for competition; how the mechanism is in which exclusionary and anticompetitive effect arises by the conduct.

    航空産業における競争政策を考えるための制度理解、法運用の実情、競争法上の独占的事業者による他者排除行為に関する最新の研究理論の検討を深めることができた。
    これらの研究により、航空産業において独占的既存事業者が新規参入者に対する排除行為を行うなど、競争制限行為を行いそうな場合・現に行った場合に、これを規制するための違法性判断基準がいかにあるべきか、制度設計がいかにあるべきか、を考えるための重要な基礎を得ることができた。

    平成12年度においては、前年度に抽出した現行不当廉売規制についての問題点について、米国やEUにおける略奪的価格設定規制との比較法的検討、および産業組織論をはじめとする経済学的観点からの検討、を行った。それにより、現行の違法性判断基準には、ある程度の合意はあっても、より厳密な議論が充分にはなされていないこと、一貫性を欠く部分があることを明らかにした。さらに、比較法的検討を通じ、しばしば主張されるような米国やEUの判断基準を日本に用いる場合、法体系上の問題、及び解釈論上の問題があり得ること、そしてその具体的な問題点を指摘した。また、従来政府規制のもとにあった産業における規制緩和と不当廉売規制との関連では、航空産業について研究を行った。航空産業については、日本の現状とともに、自由化から20年以上の歴史を持つ米国における航空産業において発生した、独占的既存事業者による新規参入排除の問題について、米国運輸省と司法省の対応について調査した。これらの研究成果については、平成12年度日本経済法学会にて報告し(個別報告)、また近日出版予定の単著「略奪的価格設定と反トラスト法」に、詳細にまとめている。
    同じく、規制が緩和されつつある規制産業として、電力産業に関心を持っており、日本の電力産業における規制緩和の状況と、そこで懸念される競争政策上の問題について研究を行った。これについては、アジア経済研究所の「平成12年度経済構造改革支援共同研究事業(通産省受託)『日本・インドネシアの競争政策と法』」のインドネシア・ジャカルタでのワークショップにおいて"Deregulation and the Competition Law and Policy〜Regulatory Reform in the Electric Power Industry in Japan〜"と題する報告を行った。このワークショップでの報告は、英文の論文として、後記11記載の報告書に掲載される予定である。
