    A feature of the constitution thought of the Showa prewar peri od, is to reject any constitutional amendments. Because Meiji Constitution was a cons titution granted by Emperor Meiji, constitutional amendment meant the destruction of the national polity. By that trend of thought, attempts national remodeling failed en tirely and state of Showa prewar Japan was dysfunctional.

    政党政治家による政党政治擁護論は、通常、民主政治先進諸国の理論・事例を援用してその正統性を訴えるものだと考えられている。しかし近代日本に於いては、政党政治を敵視する藩閥政府を説得しながら、国民の信頼をかちとるために、政党政治家は「政党政治は明治天皇がつくった欽定憲法の趣旨に適うものである」との論法も併用していた。この傾向は「憲政の神様」と称揚された尾崎行雄に顕著に表れる。政党政治家は欽定憲法史観の普及に寄与したのである。

  • 「欽定憲法」に関する歴史認識の形成と定着に関する歴史的研究

    「欽定憲法」に関する歴史認識の形成と定着に関する歴史的研究と題して、帝国憲法下の憲法観を解明することが本研究の目的である。この研究によって、従来の、憲法学者の学説を紹介することに終始してきた日本憲法思想史は、新しい研究段階に進歩する。歴史認識としての欽定憲法観は(1)明治天皇の主体性強調、(2)その裏返しとして伊藤博文らの従属性強調ないしは役割の矮小化、(3)天皇と臣民が平和的関係の裡に憲法制定を行ったこと(4)憲法制定・議会開設は明治維新完成=第二維新であること、等の意想を構成要素とする。この四条件の形成と定着を政府と民間の両面から考察する。かかる歴史認識は一般に政府と民間の合作によって作られ、それによって初めて定着するものと考えるからである。平成17年度には、論文の作成に取り組み、「欽定憲法」に関する歴史認識の形成について結論を得た。すなわち、明治14年から明治22年にいたる伊藤博文と井上毅の政治指導の分析を通じて、明治20年の大同団結運動・三大事件建白運動によって第一次伊藤内閣が崩壊したことが、欽定憲法史観形成の歴史的要因であることを解明したのである。また、内閣制度の成立についても、内閣職権、内閣官制にかんする通説を批判し、これを是正した。本原稿は400字詰原稿用紙に換算して1100枚程度の分量に達した。しかも個別論文の集積ではない。そのため、本研究の成果は雑誌論文とし...

  • The Relation of Japan and Korea in Modern Era and Local Society

    (1) The study for the army that repressed Togaku peasants army : We investigated the Defence Agency Library, Ministry of Foreign Affairs Archive, National Diet Library and Ehime prefecture Library, we found the documents about the Twenty-second regiment in Matsuyama that repressed Togaku peasants army. (2) Japanese Colonialize Study and the Japanese view about Korean : The colonialize study in Hokkaido Empire University contended the immigration to Hokkaido. But it changed the emigration to Manchuria and Korea after 1902. The immigration to Hokkaido failed in making big class peasant. The Japanese people's view about Korean was different from the foreign countries people. (3) The study for colonial policy in Korea : We investigated the Korea Center Library, Korea National Diet Library and Korea National Archive, we made preparations for the following study. We made the catalog of the pamphlet in Hokkaido University Library, we could find many articles about prewar Japan and Korea. (4) The study for the mobilization in W.W.II : We researched for the documents of Hokkaido Coal Mine Steamship Company, the summary of these documents reported at the symposium in National Institute of Korean History.
