    ２年目にあたる本年度は、近世日本における隔地間取引と為替制度の発展の背後に、信用をめぐる、いかなる人々のいかなる意識が存在し、またそれが通時的にいかに変容するかについて解明することを中心的に試みた。特に初年度の研究から、大坂における商業信用の突出した発達が窺えたため、主に大坂商人の意識を、他の都市の商人と比較しつつ、上方の文芸や、商家の家訓・家法などの分析を通じて明らかにするように努めた。
    その結果、都市による意識の差もあるが、御用商人か否かといった、幕藩権力との関係の強弱も、他の商人との関係の築き方やその間における信用の供与の仕方に大きな影響を及ぼしていることが分かった。また、近世を通じて、商人が、同業者仲間や町といった、職縁・地縁・血縁等による、時に重なり合う様々な共同体に属しており、それらが、構成員への信用の供与に大きな役割を果たしていたことが窺えた。こうした共同体は、連帯的精神のもとに、その内部では相互扶助的な信用の供与を行うことが多いが、一方で、その強固な連帯が、構成員を相互に監視させ、他の構成員に迷惑をかけた者を追い詰めてゆくという方向に働きがちであったことも、とりわけ近松門左衛門の作品には、はっきりと描かれていた。このような多様な共同体は、その相互関係や権力との関係を複雑に変化させつつ長く存続してゆくが、明治期に入ると、大都市を中心にその弱体化が顕著になり、共同体的連帯に基づく相互扶助的な信用も成り立たなくなってゆくことは、当時の樋口一葉の日記などから明らかになった。
    また、こうした近世から近代初期の日本のテクスト分析の作業と並行して、初年度と同様に、信用に関する２つの研究会にも参加を続け、異なる地域や時代の様々な信用問題に関する報告を聞き、視点の多角化や考察の深化に役立てた。

  • The social structures in early-modern Japan concerning the family and succession

    This study aims to clarify warriors’ and townspeople’s views of the family and succession, and the social structures behind them, by analyzing “OIE SODO” (a family feud about a feudal lord’s succession) and “OIEMONO” (a drama about that story), which are characteristic of early-modern Japan. As a result, it has been discovered that “OIE SODO” was frequently promoted because of the warriors’ views, which attached greater importance to the succession of the lords’ families than to the lords as individuals, or fiscal disputes among vassals, while the fashion of “OIEMONO” after the mid-Edo period was closely related to the change of merchants’ management policies from venture-oriented to focused on steady family businesses. In addition, in comparison to early-modern French and Chinese literature, the conspicuous characteristics of Japanese social structures, such as the weakness of the solidarity of the bourgeoisie, have been demonstrated.

  • 団体の比較史的諸形態と法人理論の基礎

    昨年度に予告したとおり本年度は公共団体の問題に活動を集中した。その集大成は3月にKinch HoekstraとLuca Ioriを迎えて行われた「ホッブズとトゥーキュディデス」に関する研究会であり、事実上の締めくくりとなるに相応しい濃厚な二日間であった。つまり古典古代と近代をまたぎ、また国際間の衝突もテーマであったから国家間の問題、近代国家共存体制外の地域の問題、をも視野に入れた。ホッブズはまさに枢要な交点である。そのポイントで、公共団体立ち上げの条件を探った。ゲスト二人の報告は或る雑誌に翻訳して発表の予定である。また、研究代表者自身、この研究会に至る中で同時並行して一本の論文をまとめ、『国家学会雑誌』に発表した。後者は、このプロジェクトが深くかかわってきた法人理論がホッブズにとって有した意義をも論ずるものである。また、ともに、自生的な団体と深く関係するメカニズムである互酬性を、そのメカニズムの極限的なフェイズをホッブズがいかに利用しつつ克服するか、を追跡した。こうした考えをホッブズはトゥーキュディデス読解を通じて獲得した。彼が同じく翻訳したホメーロスを含め、ギリシャの社会人類学的洞察をバネにしたことになる。こうした見通しは、本研究会が遂行してきた広い比較史的視野を有して初めて持つことが可能になる。その意味では、今回の成果は、公共団体をターゲットとしてきた本年度の活動のみならず、全期間の活動の凝縮点である。付言すれば、教育目的ながら野心的な内容を含む拙著『現代日本公法の基礎を問う』も同一の軌道を回る惑星である。

  • The townspeople's consciousness of the government and international relations in the early Edo period

    This study tries to clarify the townspeople's consciousness of the government and international relations in the early Edo period, by analyzing Chikamatsu Monzaemon's "Joruri"(traditional puppet theater scripts) and related texts. This analysis has discovered that in this period the townspeople of the Kamigata district expressed their resentment to the repressive regime, became more interested in foreign cultures, and wished to conduct free external trade, having little hope to build an autonomous economic society under the government of that time. However, in the latter half of the eighteenth century, their resistance to the regime rapidly waned and their view of foreign countries also changed radically.

  • The social structure and civil trials in the Kamigata district in the early Edo period : Comparative analysis of literature in early-modern China and Japan

    This study focuses on a series of court stories which were mostly adapted from Chinese originals and became popular among townspeople in the Kamigata district in the early Edo period. Its aim is to clarify the reason why keen interest in civil trials-which had not been expressed in Chinese originals nor earlier Japanese literature-suddenly appeared, by analyzing the social structure of the Kamigata district. As a result of the analysis, it has been discovered that small local communities called 'Cho' in that district were profoundly related to civil trials. Also, the high awareness of the functions of 'Cho' and civil trials was developed by composing linked verse, which enjoyed a boom among common people at that time.

    本研究は、平安朝の物語とこれに重要な影響を与えた唐代の伝奇小説との比較分析に基づき、その担い手たる知識人の意識変化と、これらの隆盛と前後して起きた社会変動との関係の解明を目指した。その結果、唐では科挙官僚等が、身分秩序と結び付いた従来の価値観に挑戦する新たな考えを伝奇の中で明確に先取りするのに対し、平安期の文人貴族や宮廷の女房は、貴族制の変化やそのもたらす問題を物語で鋭く示唆しつつも、それに積極的に関与せず距離をとることが明らかになった。

  • 和歌・歌物語にみる平安貴族の意識構造--日本における「政治」批判の典型の成立

    本研究は、いわゆる摂関体制が確立した平安中期に焦点を当て、僅かな権勢者間の利害調整と化していた当時の「政治」に対し、表向きは逆らわずただ文芸の世界に閉じこもることによってそこから敢えて距離をとる、という消極的な形の批判を示した、文人貴族や没落貴族の意識構造を、主に和歌や歌物語等の文学史料の分析により解明したものである。抒情詩の一種である和歌は、権力から距離をとる意識構造を涵養する側面を持つ一方で、儀礼の場で用いられ、天皇および摂関家の権力と堅固に結びついて発展してきたという歴史的背景をも有する。後者の面を如実に示す一例が、当時繰り返し編纂された勅撰和歌集であるのに対し、前者の面を引き立てる好例が歌物語であり、これらは、政治的な問題を鋭く意識しつつもそれに直接言及することは避け、敢えて勅撰和歌集に採録されない和歌を取り上げることによって対抗意識を示したり、反摂関家を象徴し貴族社会の規範に囚われない人物を、主人公に仕立てたりしている。政治権力から離れたところで個人的な自由を享受しようとする態度は、歌物語に大きな影響を与えた唐代の伝奇小説の作者にも見られるが、彼らが一方で儒教の価値観に規定されており、こうした観点からの評言を作品に付すことがあるのに対し、歌物語にはそのような記述は見られない。ここに端的に表れている、平安中期の貴族社会における儒教の弱さは、文芸作品に内在する価値の一貫...

  • 古代日本における文学と「法」の関係-平安前期文人貴族の貴族制構想を手掛りとして

    前年度は、平安前期の漢詩文と法制史料を分析し、その通時的変化に深く関わる文人貴族の意識構造と、それに支えられた貴族制構想の概要を解明したが、今年度は、この文人貴族の構想が挫折を余儀なくされることではじめて成立した、摂関期の貴族制について考察し、両者の比較により、それぞれの特質や意義を浮き彫りにするとともに、貴族制という観点から議論全体を構造化することに努めた。具体的には、まず、摂関期の漢詩文学や貴族の日記、儀式書等を分析し、当時の君主と貴族、および貴族同士の間には、平安前期の文人貴族が主に詩を通じて築き上げようとした、距離をおいた明確な関係は存在せず、むしろ相互依存的な関係が見られることを明らかにした。平安前期の文人貴族と摂関期の貴族との、この点に関する相違の最大の要因は、恐らく彼らが身に付けていた教養の差異にあると思われる。前者は詩人かつ儒家で法の解釈能力も高いことを、少なくとも理想としていたが、後者は、儀式作法や政務に関する先例や故実を心得てさえいれば、とりわけ詩作によって保証される、全てから距離をとった自分自身の視点で物事を判断する能力を求められてはいなかったからである。次に、単行法令をはじめとする、平安前期と摂関期の法制史料を比較し、貴族と在地社会の関係の相違について考察した。平安前期の法令は、当時拡大しつつあった、血統貴族と在地富豪層との個人的な結合関係を禁止する方...
