  • 効果的な再犯防止を実現するための改善指導のあり方についての総合的研究

    本研究は、最近の我が国の立法状況と実務運用の現状と課題を国際的な視点からの検討しながら考察し、効果的な再犯防止を実現するための改善指導のあり方を検討することである。３年目は、自らが意図せずに加害者となる事案に着目し、それゆえに、自らの犯罪に向き合うことの難しい事案、すなわち改善が難しい事案について以下のような研究実績をあげた。
    （１）北大刑事法研究会において「いわゆるすり替え型キャッシュカード窃盗の事案において、被害者方のインターホンを押した時点で窃盗罪の実行の着手を認めた事例」と題する報告を行ない、刑法解釈論のみならず、刑事政策的観点からの分析も行った。本件は少年事件であり、行為者は組織的に利用された側面が強いものである。
    （２）「ＧＰＳ機器の利用に伴う刑事法的違法性のパラレル構造」寺崎嘉博先生古稀祝賀論文集下巻（成文堂、2021年12月）437-446頁において、ＧＰＳの濫用について検討し、ストーカー規制法の処罰の間隙をどのように埋めるかを論じた。論文公表後、これについての立法の手当てがなされ、時機を得たものとなった。とくに本論文は、民間人と公的機関によるＧＰＳの利用の違法性の問題を総合的に検討した視野の広い、意欲的な論文となっている。
    （３）研究全体としての遂行状況に関しては、２０２０年４月以降の新型コロナウイルス感染拡大防止のため出張が制限され、個別の意見交換の機会が実現できなかった。また、継続的に実施している少年院での再犯防止啓蒙活動も、同じ理由で一度も実現できなかった。

  • A comprehensive study on support for children whose parents have committed the crimes

    Even though a parent has committed a crime, the child is not responsible. In reality, however, children whose parents have committed crimes are exposed to various mental, physical and economic disadvantages in homes, schools, societies, and the like. In this research, we divide parents' crimes into cases of abusive cases (regardless of whether they are reported to the police or not) the child itself (including family members) is a victim, and cases where the victim is other than the family, International standards centering on the Convention on the Rights of the Children, and what kind of legal support can be made from various fields including efforts by developed countries. We also examined prevention measures for abuse and the legal system for the case. In cases where parents are sitting in prison, we made proposals to Japan based on international standards regarding child rearing in the prison, visiting to the prison, etc.

    Place in the basic treatment of men, so far, has been thinking about the treatment of women as being exceptional in prison in Japan. In this study, we interviewed at some Japanese criminal institutions in Japan, at some foreign countries about gender perspective treatment (for both men and women). In addition, we conducted a questionnaire survey for men and women inmates, to prison officers at some Japanese prisons. At the last year, we held the international seminar on treatment of the female inmates and introduced foreign situation and pointed the current status and issues in japan. Finally we recommended the need for treatment from the gender perspective.

  • Study on after-care system for probanden over smartphone

    The Way of aftercare to promote the social reintegration of inmates, it has become an important issue of criminal policy. In this study, by possession and using of a smartphone to probationers and parolees, as well as to develop a system that electronic monitored by the outgoing signal, I aim to improve the quality of communication with the volunteer probation officers, the prevention of recidivism and the smoothly rehabilitation as the aftercare. I reached to the conclusion that utilizing the smartphone as such criminal policy implementation tool should now be seriously considered.

    This research considered below 2 questions concerning measures for woman and child victims on the aspects of the comparative law (between Japan, South Korea, Sweden, Finland, the United States, and Germany). 1) The problem of the situation of legislation. 2) The correspondence of the justice administrations and social services, and the cooperation by each organization. Besides we made the questionnaire investigation, the interview investigation, add to the casework research on the current Japanese situation from the viewpoints of the law, psychiatry, the social psychology, etc. It was clarified the problems in the current Japanese situation, and examined those problems, and the points that Japan has been doing a great advance much more compare with other countries were also clarified.
