新型コロナ感染防止のため海外現地調査ができなかったことにより．2021年度においては日本国内の大学職員の実態調査とともに，日本の労働環境，雇用のあり方に関する理論研究を行った．これまでの研究によって得られた検討結果は以下のとおりである．
メンバーシップ型としての日本の大学職員の特徴として(1) 強い共同体性，(2) 専門性への忌避（総合職志向），(3) 強い独立性を持つ〈事務局〉への一元化，の3点を抽出した上で，かつて盛んに論じられたアメリカ型専門職モデルへの移行が実現していないのは，日本の大学職員が「メンバーシップ型」という，欧米では一般的な「ジョブ型」とは大きく異なる雇用労働システム下にあり，システム全体の差異，例えばその〈共同体性〉を無視して「ジョブ型」に移行することは，それが職員の内発的必要性に発するものでは無かったからである．日本の大学教員と職員の協働および職員間の協働では，明示的な役割分担・職務分担だけでなく，グレーゾーンの部分がどう担われているのかなど多くの部分が暗黙知により支えられている．したがって暗黙知の重要性を認識した上で，組織内の経験を継承・発展していく仕組みを構築することが重要かつ現実に求められている．

日・韓・台の大学には採用や昇進などの点ではメンバーシップ型としての同質性が見られるものの，組織内部のあり方が異なることがメンバーシップにも影響を及ぼしているように思われる．日本の大学職員に対する新たな役割モデルを提言するには，さらなる現地調査と韓国・台湾の研究者・職員との研究交流が必要である．

(1)国立大学の改革文書の収集と整理に努めた。国立大学協会事務局の協力を得て収集した大学問題に関する研究部会審議資料（大阪大・広島大等）ほか関連資料の整理を行った。
(2)1968年前後に政府において検討されていた高等教育政策（中教審1971年答申として結実）について、中枢にいた文部官僚（西田亀久男・天城勲）の回顧録等、同時代の批判（OECD調査団、大学関係者）等とつきあわせながら論理を分析し、今後の研究課題を検討した。これらにもとづき学会において研究発表を行った。
COVID-19パンデミックは以上に関して困難をもたすものであった。特に各地の大学を訪問することはまったくできず、資料収集に大きな支障を来たした。その一方で、
(3)COVID-19パンデミックは、学生が周縁化されていることを浮き彫りにした。すなわち、学生はオンライン授業や課外活動の禁止によりキャンパスから閉め出されたのみならず、その決定プロセスからも排除されていた。また、経済的困窮およびキャンパスを利用できないことなどを利用に全国で学生の学費減額運動が展開されたものの、学費減額に応じた大学は皆無であった。また、学費負担に関する大学側の見解は説得的なものとは言えなかった。これらの状況は、学生が依然として施設の利用者の地位にとどめられ、教育に関する権利を行使する者として扱われていないことを示している。
(4)同時に、学生の運動は学生自身の教育要求の明確化に寄与するものであった。また、学生団体の交渉権の有無が大学の組織運営を適切におこなっていく上で重要であることを示唆する事案が各地の大学に発生した。これら2021年の動向に関して情報収集と整理を行い、今後の課題を検討した。これらの成果は、雑誌論文、著書等において発表する予定であるが、いずれも刊行は2021年度となる。

本研究の目的は地方とされる社会の現代的課題、具体的には衰退する地域産業、人口減少、労働力不足という諸問題の構造の解明や解決策について、職業教育訓練はいかなる貢献をしうるか明らかにすることである。実施に当たって以下の3つの領域に分かれて研究を実施した。具体的には（1）地方における専門学校、短期大学の役割と政策に関する調査（2）企業立学校、専門職の歴史的・現代的意義に関する資料収集（3）地方産業が抱える課題と職業教育訓練に関する調査である。
（１）の領域に関しては2回の研究会（「地方私立短大の現状について」、「青木紀著『ケア専門職養成教育の研究』から考える地方の若者にとっての職業教育」を開催しながら問題関心を共有した。また、九州の専門学校進学、北海道の高等教育進学に関するデータを収集・分析し、地方ブロックごとの特徴を分析することの重要性について分析した。
また、地方の若者の総合的な状況に関する調査研究を検討する研究会を開催し（阿部誠「『地方に生きる若者たち』をめぐって」）問題意識を共有した。この領域については就労に困難を抱えた地方の若者に対する支援に関する研究、移民政策としての職業教育に関する研究成果がある（阿部誠「就労困難者にたいする就労支援の意義と社会的包摂」『大分大学経済学論集』71-6、2020年3月）他多くの研究成果を挙げている。（２）の領域に関しては中部地方の織物産地に関する資料収集を継続して行っている。（３）の領域に関しては水産業における特定技能制度に関する調査を行い、論文として発表した（佐々木貴文「水産業における労働力構造の変化―特定技能制度の背景で起きていることとは」『漁業経済研究』64巻、25-40ページ、2020年3月）。

本年度は、新教基法の各条項の担当となった研究分担者などによる報告を内容とする研究会を重ねて、本研究の目的の一つである新教基法のコンメンタール作成に向けての基礎的な作業を行ってきた。
これまでの新教基法に関する研究では、新教基法制定の背後に座っていた政治原理である新自由主義とし国家主義に基づいて、これらの政治原理がどのように各条項の文言に反映してきたのかが検討されてきた。これに対して、本年度においては、日本国憲法およびいわゆる社会権規約、自由権規約や子どもの権利条約などの国際人権法のもとにおいて確立している法原理に基づき、新教基法の各条項がいかに読まれるべきか、という観点からの検討を各条項毎に進めてきた。
その結果、新教基法を全体として各種法令を解釈の指導原理を提供するものとして位置付けること、すなわちその原理法的性格を認めることは、新教基法の全体としての憲法との順接性が失われている以上できず、各条号ごとに、憲法および国際人権との順接性の有無を確認したうえで、各条項毎に法原理性を有しているのか否かを確認すべきであるとの見解が有力視されるに至っている。そして、各条項毎に見れば、例えば、新教基法の1条にも継承されている人格の全面的発達という教育目的に基づいて、新教基法の各条項の本来的な意味を明らかにすすることができ、その結果、新自由主義などの政治原理に基づく各条項の運用を排除することができるという解釈もなしうることが明らかになってきている。

2020年度には新型コロナウィルスの影響により，予定していた海外訪問調査が全面的にできなくなった．このため，日本における大学職員の現状の役割モデルについて重点的に検討し，特に近年の大学ガバナンス改革を受け変化している現状とその課題について，韓国・台湾との対比により検証した．さらに濱口桂一郎（2013年）が世界で標準的な雇用形態「ジョブ型」と対比する形で提示した「メンバーシップ型」として日本の大学職員を，その特徴として①強い共同体性，②専門性への忌避（総合職志向），③強い独立性を持つ〈事務局〉への一元化，の3点を抽出した．かつて盛んに論じられたアメリカ型専門職モデルへの移行が実現していないのは，日本の大学職員が「メンバーシップ型」という，欧米では一般的な「ジョブ型」とは大きく異なる雇用労働システム下にあり，システム全体の差異，例えばその〈共同体性〉を無視して「ジョブ型」に移行することは，それが職員の内発的必要性に発するものでは無かったからである．本研究計画で遂行した現地調査および情報収集を踏まえ，現段階で得られている知見と中間的仮説は以下の通りである．
■韓国・台湾とも教員が事務管理職を兼務していることが多く，また上級職員の中に少数ではあるがアメリカ式のジョブ型雇用と専門職能資格制度が見られる．
■多くの一般職員は日本と同様の一括採用であり，人事異動もあることからメンバーシップ型に近い特徴を持っている．部署別採用もあるが，採用後数年で人事異動の対象となる．
■韓国・台湾とも，職員は学内において〈事務局〉のような形で一元的に組織化されてはおらず，教員組織(学部等)と同様に学長のもとにある個別部署に所属している．
■台湾で一般職員に大学院での修学が奨励されるのは，社会人大学院が普及しているという一般的事情とともに，所属長が教員であることの影響もあるのではないか．

(1)大学の基準の動向に関する検討
大学の設置の動向に関する研究の一環として、職員（事務職員）に関する諸基準の検討を行った。職員に関する基準は、学校教育法においては他の学校種と同様、小学校の事務職員の条文を準用している。また、大学設置基準においては、組織に注目した規定となっている。旧国立学校設置法においても、職名毎に職務権限を区別しているだけであり、職務内容に関する規定を行っていない。これら法令上の規定は、行政組織権による職員の統制を可能とする一方、職員の職務能力の開発を妨げる一因になってきたと考えられる。①職員の地位に関する行政、職員団体等関係者の認識、②昇格、異動等、他の職員制度との関連、③法人化以降の法制と実態の変化、を明らかにしていくことが課題となる。本研究の成果発表は2021年3月の大学評価学会において行った。
(2)大学経営の改革に関する政策動向の検討
政府の国立大学法人の経営改革に関する検討の内容を分析し、背景、目的、制度改革の影響に関する考察を行った。2020年に文科省「国立大学法人の戦略的経営実現の実現に向けた検討会議」において行われた検討は、国家改造、社会経済改革の方向と合致する大学改革を推進することを目的としている。そのため、国立大学の存在意義を明確にするための行財政制度のあり方を論点としながら、現在の中期目標・中期計画による国家統制をさらに強化するの改革論に収束することになった。検討が、国立大学法人と政府との関係を個別的なものから集合的なものへと移行する提言を行ったことは、その政策的意図とは別に、大学行政制度の政府からの独立が必要であることを示しているといえる。本研究の成果発表は複数の雑誌への投稿により行ったが、いずれも刊行は2021年度である。

Second, the meaning of the relation of college that train the kindergarten teachers and the enterprise that make the break system. And the character of career guidance who wants work while leaning. Third, the character of the career of the kindergarten teachers and dietitian who gradate the training college or university.We can make clear the relation of the women’s vocation and the vocational education and vocational training in the historical and modern points of view.

Article 13 of ICESCR stipulates the"Right to Education"as a human right. Its nature is not only an empowerment right but also a key right. The Japanese government withdrew its reservations for"in particular by the progressive introduction of free education"in 2012. Since article 98 of the Constitution of Japan provides an obligation to faithfully observe the treaty, the Japanese government has a task of switching its policy toward free education (2012 Conversion Task). It should be distinguished between"inability to comply"and"unwillingness to comply". Citizen's activities to monitor the government are important to fulfill the 2012 Conversion Task. In order to form a consensus toward expanding the public expenses system which supports and promotes mutualistic cooperative child-care and education, we made a prototype for the progressive introduction of free education which combined national policies, prefectural/municipal measures, corporate management methods and private businesses.

This research revealed the following:1) The contents of "university governance reform" policy in detail, related trends and issue, 2) Decision process of organization, work: Are they performed based on Objectives, evaluation from relations with legislation in particular and the actual situation, 3) Examination about other elements burying between university corporation resume and the present situation of the organization administration of universities, and arrangement of problems.
I reached the following conclusion. First of all, political intention and administrative guidance are invading between corporation laws (national university corporation, public university corporation) and the actual state of the organization administration of universities. Second, such a situation is due to a problem of the governance of organizations, finance, and the university evaluation.

For the years, which this research grand covered, the government has carried out comprehensive reform of educational system rapidly, including the stratification of the school system and the organizational reform of the local educational administrations. This reform helped us get the whole picture of the system of new education law under the New Basic Act of Education of 2006. As the reform would continue from now on, we clarify not concluding but preliminary two observations. First, though the principles embedded in the Constitution of 1947 and the former Basic Law of Education have been challenged by the new system of education law, they still work and set limit on the reforms. Second, the stratification of the school system and the comprehensive control of educational activities by standardized testing led by the Cabinet Office and the governors’ offices showed that the education reform, which has been driven by the neo-liberalism for these 30 years, moved into its third stage.

The aim of this research is to identify the legal issues in harmonizing the new Fundamental Law of Education(the new FLE) enacted in 2006 to the constitutionalism. We analyzed not only the new FLE but also the related enacted laws and draft laws prepared by the ruling parties. The fruits of this study are as follows. First, the political trend at the central and local levels for adopting new educational laws is to enhance the neoliberal scheme incorporated in the new FLE. The draft educational laws prepared by Japan Democratic Party before they came to the power in 2009 and new educational ordinance of Osaka prefecture and city are typical of this trend. Second, the key to anchor the new FLE within the framework of the constitutionalism resides in the prohibition of "improper control" as is stipulated in Article 16 of the new FLE.

Recently, the neo-liberal higher educational reform has been global trend. The neo-liberalism sifts from the stage to introduce market mechanism to the stage bearing new means of control by the state power through the mechanism. The higher educational reform is the same. But conditions are different from, the region or the nation. We used following way for analysis of this subject. Firstly, as the analysis framework, it is (1) the legal status of the university, (2) the administration and management, (3) the organization of research and teaching,(4) the university evaluation system, (5) the faculties' status, and (6) the problem of finances. Secondly, as the research target, it is America, England, New Zealand, Japan , Indonesia, China, Korea, and Vietnam. And then, we examined what is the condition of Japanese reform (especially laying down national and public university corporation) among those countries.As a result, it is clarified the moving to the national and public university corporation in Japan is seen unique and remarkable. In comparison with America, England, and New Zealand which are advanced neo-liberalistic reform, and Asian region(Indonesia, China, Korea, and Vietnam)which maybe aim to follow theirs.Firstly, sift to the Japanese national university corporation was carried out all at once and uniformly. It is unusual example Secondly, the government's direct control of Japanese universities is greatly intensifying. It systematically participate with the decision making of the university goal and plan, the assessment of their accomplishments, and the distribution of the university budget. Thirdly, the internal governance of the university shifted the management of the private enterprise type. Thereby, the authority of the university and the "academic freedom" has been reduced and deprived.

1.前年度収集した地方高等教育政策に関する資料の整理・データベース化をすすめた。ここから得られた知見をてがかりとして、研究発表を行った(日本教育政策学会、平成18年6月)。2.下記の高等教育機関、地方高等教育行政機関および関連機関における資料収集と聴き取りを行った。(1)名寄市立大学(平成19年3月)、(2)拓殖大学北海道短期大学(平成19年3月)、(3)NPO法人新規就農サポートセンター(平成18年12月)、(4)高知女子大学・高知短期大学・高知県企画部私学・大学支援課、幡多地域ゼミナール館(平成19年3月)、(5)公立大学協会(平成18年12月)3.地方都市に立地する大学・短期大学の調査からは以下のような知見が得られた。(1)近年の改革動向は地域社会にとっての大学の必要性を正面から問うものとなっている。その中から、地域との連携による看護・福祉・栄養の統合教育(名寄市)、新規就農者の育成・支援(深川市)、郡部における自治体職員の学習支援(高知県)など、地域における人材の育成を地域社会め存続・発展の鍵と見て、そこに大学を関わらせようとする動きが目立つ。(2)地域的な役割や課題に対応した大学改革を政策化するにあたって、大学だけでなく、地域の諸団体や住民運動が重要な役割を果たしている。地域的な高等教育のあり方が教育・文化自治とかかわりながら発展しているとの示唆を受ける。(3)地方自治体の高等教育行政の体制は全般的に未成熟であることは、地方行財政改革が進む中で、地方自治体のサポートを必要とする高等教育にとって重大な脅威である。その負の影響を回避する方法、および、行政資源が不十分であることを奇貨として、高等教育政策を住民の教育・文化自治のもとにすすめるような高等教育政策のあり方の究明が今後の課題であることが明確になった。

1.The purpose is to investigate the current status and process change of local educational administration at prefecture level in the time of decentralization.2.I selected Nagano and Tottori prefecture which is aggressive in local autonomy, and visited and interviewed governor' s departments and agencies, office of board of education, teachers unions and universities to change of local educational administration at these prefectures after non-partisan governors won the elections. I recognized both these two prefectures strengthen the disclosure of information, brought transparency to the administration process and made policy decision not behind closed doors but more openly. The relations among governor, the prefecture legislature and board of education and personnel selections of prefectural advisory bodies in area of education.3.In Nagano, the governor took the initiative and reflected his policy in policy decision of board of education, and then the governor conflicted with the prefecture legislature and municipalities. In Tottori, Reform and Independence Promotion Office was set as a crossing organization among prefectral departments and agencies and coordinated them including board of education. I observed common tendency that measures and policies of board of education were made with demand of governor' s office and the difference between two prefectures that made the style of coordination of prefectural departments and agencies.4. The conflict-the prefecture and the board of education VS prefecture legislature, municipalities and boards of education-in Nagano meant changing of local governance under financial cut and a dwindling number of children.5. On higher education investigation, we visited Akita prefecture in addition to these two prefectures. Three prefectures started out to support local higher education. But the main purpose of those supports is to develop local industries. We observed that prefectures intervened local universities with an authoritative of prefecture payment. It is a big problem to make democratic control system in improving local higher education.

This study was aimed to do research on University Partnership and Social Contribution provision to the Community.We had a plan to make a study model. It was classified as four model, such as community based model, retraining mature students model, consortium model and University partner ship with high school model.We had done field research according to the original plan and had some good results. Field research Universities were divided into four local areas, for instance, Universities located in north parts of Hokkaido, Fukushima university, Consortium Kyoto and Wakayama University.In order to do research we had a discussion meeting in Tokyo, Sapporo and Osaka.We had collected many materials and interview records through from field research. We also gained research results including some evidence and lessons.As for four cases, our interim analysis were below,In Hokkaido cases, some University made efforts to bridge partnership with local enterprise and local people's lifelong learning using University resources. And they tried to make relationships like a consortium style among different colleges.In Fukushima University, academic staff there had tried to give lectures and degrees for the people they once graduated from high school and junior college. Such provision had been done as a day and night courses. Nowadays it is not rare to make professional courses for the mature graduate school students but it is still few to provide professional blush up undergraduate student courses for the mature workers.In Consortium Kyoto, they had well done to provide plenty of courses for the students belonging different type of Universities and colleges in Kyoto area. Their activities were supported by Kyoto city council and Universities they were membership of Kyoto Consortium. This research had analyzed the practice structure and social movement structure.Wakayama University, especially center for education and research of lifelong learning had a reputation for unique activities in its region. This partnership provision with Kokawa high school and Wakayama University made a collaborative learning among high school students, university students, local people, high school teachers and university researches.So, our research achieved some new findings and made some new analysis on that study plan.We published a study report on this March.
